Do I need a building permit?nGenerally, you need a permit to build or repair just about anything with some exceptions. The Ontario Building Code (OBC) defines a building as a structure greater than 10m2 (108 sf), so if the structure is small a permit may not be required. If that structure has plumbing, then a permit would still be required. So, if you have a pool but want to create a small outdoor shower space, then a permit would be required. nThere are some other generalities as well. You want to build a small 10’ x 10’ deck. It’s less than 108 sf. You should be good to go but once you attach it to the building, your home, it is now considered part of the entire structure, so would need a permit. What’s the work around…. Don’t attach it. If it’s less than 108 sf and free standing, you should not need a permit. There’s still one caveat…if it’s more than 24” high you would still need a permit. You might try fighting with the building department as it seems to be within the OBC guidelines, but you’ll likely be fighting a losing battle. Just imagine that 10x10 deck that is 8’ off the ground and free standing. It likely won’t stay there long and someone will be hurt or worse when it collapses. There is a reason to insist on permits.
