House deposit, where does it go if the sale is not completed by the buyer on closing day? It's important to understand that the house deposit does not automatically revert back to the vendor if a deal falls through on closing. The deposit will remain in trust until the transaction is finalized or until both parties mutually agree on its disposition. If the buyer fails to complete their house purchase on the closing date due to their own fault, the deposit they put down is at risk. In such cases, the seller normally is entitled to keep the deposit as compensation for the breach of contract, but it is important to note this does not just happen automatically as these funds are held in a trust account and can not just be released without proper instruction to do so. It's always recommended to consult legal counsel and review the terms of the agreement to understand your rights regarding the deposit in the event of a failed deal.
